InstaPeep ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

InstaPeep is a tool that allows users to view publicly available content from Instagram. We do not host, store, or cache any Instagram content on our servers. All content displayed through our tools is fetched directly from Instagram's publicly accessible infrastructure and displayed in real-time. Once you leave the page, the content is no longer available through our platform.

How Our Service Works

It is important to understand how InstaPeep operates in the context of copyright:

• No content hosting: We do not upload, store, or host any Instagram photos, videos, stories, or other media on our servers
• Real-time fetching: Content is retrieved from Instagram's public API and CDN in real-time when a user makes a request
• Public content only: We only display content from public Instagram profiles that is already freely accessible to any internet user
• No modification: We do not alter, edit, or modify any content from its original form
• Transient display: Content is displayed temporarily and is not permanently stored or cached

Filing a DMCA Takedown Notice

If you are a copyright owner or authorized agent and believe that content accessible through our service infringes your copyright, you may submit a DMCA takedown notice. To be effective, the notification must include the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to permit us to locate the material (such as the URL where the content is accessible through our service)

Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with us containing the following information:

1. Your physical or electronic signature
2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
4. Your name, address, and telephone number
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original notification

Repeat Infringers

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances, services to users who are deemed to be repeat infringers. We may also, in our sole discretion, limit access to our service or terminate access for any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Important Considerations

Content Available on Instagram

Since InstaPeep displays publicly available Instagram content in real-time without hosting it, the most effective way to remove content from appearing on our platform is to:

• Remove it from Instagram directly: Delete the post, story, reel, or highlight from your Instagram account. Once removed from Instagram, it will no longer appear on InstaPeep.
• Make your account private: Switching your Instagram account to private will prevent all third-party tools, including InstaPeep, from accessing your content.
• Report to Instagram: If someone has posted your copyrighted content on their Instagram account, report it directly to Instagram through their reporting tools.

Fair Use

Before submitting a DMCA notice, please consider whether the use of the content may be protected by fair use under Section 107 of the Copyright Act. Fair use takes into account factors such as the purpose and character of the use, the nature of the copyrighted work, the amount used, and the effect on the potential market for the work. Misrepresentation of infringement claims can result in liability under Section 512(f) of the DMCA.
